IRAM is a narrowly-tailored program, based on the developer’s 16 years of experience as a construction claims analyst/attorney (30 years overall in the construction industry). For a contractor, owner or anyone involved in the construction contracting process, the information in IRAM is invaluable when faced with a potential construction contract claims / disputes situation.

A successful construction claim requires two components; proof of entitlement, and proper calculation of quantum (damages).

  • The Claimant must first establish entitlement to the claimed issue, based on well established case law and contract interpretation.
  • Next, the Claimant must calculate the quantum (damages) based on acceptable means, methods and theories of contract damages recovery.
  • For example, no matter what the entitlement issue, be it: Contract Delays, Defective Contract Documents, Differing Site Conditions, etc., there are basic questions that must be answered to establish an entitlement to damages, such as:
    1. What are the definitions & descriptions of the entitlement?
    2. What are the legal requirements to prove the entitlement?
    3. What are the owner defenses to the claim of entitlement?
    4. How can the owner avoid claims of entitlement?

The calculation of quantum (damages) are based on general contract theories, tailored for construction claims. To establish quantum, a claimant (or defendant) needs to know how the quantum component should be presented, including;

Yes. The information in IRAM is available in numerous books, texts, manuals, etc. However, these printed mediums do not have the interactive capabilities of IRAM. Construction claims information can also be acquired from construction claims consultants and attorneys. However, the costs of these sources are far greater than the price of IRAM.
